Rental Terms & Conditions

1. The operator

Boat rental services are provided by Gizmo, craft business (obrt), operating as Rent a Boat Vir, Luka II, 23234 Vir, Croatia (“we”, “us”). Contact: rentaboatvir@gmail.com, tel./WhatsApp +385 91 588 4940. These terms apply to every rental of our boats and to organised trips, together with any details agreed individually at booking.

2. Booking and confirmation

Bookings are made by phone, WhatsApp, e-mail or through the contact form. A booking is binding only once we have expressly confirmed the date and the service. When making a booking you must provide accurate information (name, contact, number of persons, and boat licence details where you rent without a skipper).

3. Price and what is included

The rental price is €300 per day (9:00, 18:00) for a Barracuda 530 boat. The price includes: use of the boat for up to 8 persons, bimini sun canopy, GPS, Bluetooth speakers, life jackets for adults and children, boat insurance, a full safety and handling briefing, and route recommendations for the day. Fuel is not included: the boat is handed over with a full tank and fuel consumed is charged at return at current prices. Discounts are available for multi-day rentals, ask when booking. All prices include applicable taxes.

4. Security deposit

A security deposit of €300 in cash is taken before departure and returned in full the same day upon orderly return of the boat, subject to section 10 (damage).

5. Skipper and organised trips

A skipper may be added to any rental for €150 per day. Organised trips with a skipper included start at €200 per group, depending on the route and duration. On skippered rentals and trips the skipper has final authority on all matters of navigation and safety.

6. Who may operate the boat

The person operating the boat must be at least 18 years old and hold a valid Croatian boat operator licence (voditelj brodice) or an equivalent foreign licence recognised in Croatia. The licence must be presented at handover; without a valid licence the boat may only be rented with a skipper. Only persons named at handover may operate the boat.

7. Handover and return

The boat is collected and returned at Luka II, Vir. Handover is from 9:00 and the boat must be returned by 18:00 on the same day, unless otherwise agreed. At handover we jointly check the condition of the boat and equipment; any existing damage is noted. Navigation is permitted in daylight only, within the navigation area recommended at handover.

8. Renter’s obligations

The renter agrees to: operate the boat with due care and in accordance with Croatian maritime regulations; never exceed the maximum of 8 persons aboard; not operate the boat under the influence of alcohol or drugs; not sublet the boat or allow unauthorised persons to operate it; not tow other vessels or objects without our prior consent; keep to the recommended navigation area and respect the weather advice given at handover; ensure children wear life jackets at all times; and notify us immediately by phone of any damage, breakdown, accident or grounding.

9. Weather and safety cancellations by us

Safety comes first. If in our judgement the weather or sea conditions are unsuitable, we may postpone or cancel the rental. In that case you choose between a free transfer to another available date or a full refund of anything paid. Such cancellation gives no right to further compensation.

10. Damage and liability of the renter

The renter is liable for damage to, or loss of, the boat and equipment caused during the rental by negligent or improper handling, as a rule up to the amount of the deposit. Damage exceeding the deposit (for example propeller, engine or hull damage caused by grounding, or loss of the boat) is charged at the actual cost of repair or replacement, and the renter may also be liable for lost rental days during the repair. The boat is insured; damage caused intentionally, by gross negligence or by operating under the influence is not covered and is borne by the renter in full.

11. Our liability

We hand over every boat in seaworthy, checked and clean condition with a full safety briefing. We are not liable for the renter’s personal belongings, nor for delays or interruption of the rental caused by force majeure or by the renter’s own conduct. Nothing in these terms limits our liability where such limitation is prohibited by law, including liability for death or personal injury caused by our fault, and nothing affects the mandatory rights of consumers under Croatian law.

12. Cancellation by the renter

Please tell us as soon as possible if you need to cancel. Cancellations due to bad weather are always free (see section 9). Other cancellations are handled fairly on a case-by-case basis; where an advance payment has been made, we will offer transfer to another date whenever possible.

13. Complaints

Any complaint may be submitted in writing to rentaboatvir@gmail.com or by post to Gizmo obrt, Luka II, 23234 Vir. In accordance with the Croatian Consumer Protection Act we will respond in writing within 15 days. EU consumers may also use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Final provisions

These terms are governed by the laws of the Republic of Croatia; for disputes the competent court in Zadar shall have jurisdiction, unless mandatory consumer rules provide otherwise. If any provision is invalid, the remainder stays in force. Anything not covered here is agreed directly, call us, everything can be arranged.
